Fine and road ban for man who refused to take breath test
A man who refused to take a breath test has been disqualified from driving all vehicles for 18 months.
Tio Smith, 47, from Devonshire, admitted not taking the test when he appeared in Magistrates’ Court yesterday.
The court heard that police stopped Smith on Glebe Road in May last year because they saw his bike was unlicensed.
Officers smelt alcohol on his breath and saw a half-empty bottle of Elephant beer inside his bike’s cup holder.
Smith refused to give police a breath sample both at the scene and at Hamilton Police Station.
In addition to being banned, Smith was fined $1,500.
