Men given conditional discharge for assault
Two men who assaulted their grandmother’s former tenant were given a conditional discharge in Magistrates’ Court.
Larry Trott, 50, from Warwick, and Danyon Trott, 46, from St George’s, both admitted assaulting Erica Simmons and entering her apartment “in a manner likely to cause a breach of the peace or reasonable apprehension of a breach of the peace” when they appeared in Magistrates’ Court earlier this year.
The court heard that Ms Simmons tried to stop the men from taking her belongings from their grandmother’s apartment on Tribe Road No 6 in Southampton, which she was ordered to vacate, in May 2023.
This resulted in the men pushing and shoving Ms Simmons and accidentally injuring their grandmother.
The men reappeared in court for sentencing last week.
Prosecutor Audley Quallo said the men’s actions were “not a remedy for [disputes between] landlords and tenants”, and requested that they each be given a 12-month conditional discharge for the offences.
Both Victoria Greening, Larry Trott’s lawyer, and Michael Scott, for Danyon Trott, requested that their clients, who apologised to the court for their actions, be granted an absolute discharge.
Magistrate Maria Sofianos said the men “acted in the interest of their grandmother” and sentenced each of them to a six-month conditional discharge.
Ms Sofianos ordered them to stay out of trouble, appear in court when required and inform their probation officers of any change in address or employment during that time.
