Man gets 18 months’ probation for common assault
A man who admitted assaulting his partner during an argument while they were drinking has been put on probation for 18 months.
Mica Fubler, 35, pleaded guilty to common assault in Magistrates’ Court yesterday.
The court heard that Fubler and his partner were drinking at her house on November 29 last year.
Fubler said something that upset her. When she questioned him about it, he allegedly hit her in the back of the head three times with a glass bottle before walking out.
The woman called police. Officers attended the residence and later arrested Fubler.
Fubler denied intentionally striking her. He claimed to police that his partner had hit his bottle as he drank and chipped his tooth, which prompted him to throw the bottle and leave in anger.
He said he recognised that the bottle may have hit her, even if it was not his intent.
The incident happened on November 29 last year.
Nicole Smith, for the defence, said that her client was “not by his nature a violent man” and that he had been using alcohol at the time to cope with personal hardships.
Fubler, from Warwick, apologised to the court and said he wanted to participate in court services that could help him address his challenges.
Senior magistrate Maxanne Anderson imposed probation with the conditions that he stay away from drugs and alcohol, and take part in any court programmes deemed necessary.
