KeyTech applies for relief from 60-40 rule

Telecommunications group KeyTech Ltd has signalled its intention to attract more investment from overseas.A statement from the Bermuda Stock Exchange yesterday said the KeyTech had written to Business Development Minister Wayne Furbert to give notice of its intent, effective 14 September, 2012, to seek relief from the 60-40 rule.The company is taking advantage of this year’s amendment to the Companies Act, which allows local publicly traded companies in certain industries to apply for permission from Government to increase the proportion of foreign ownership to beyond the current 40 percent limit.KeyTech owns the Bermuda Telephone Company and Logic Communications, as well as stakes in CellOne and Bermuda CableVision.In its letter to Mr Furbert, KeyTech wrote: “KeyTech Ltd, whose registered office is at 30 Victoria Street, Hamilton HM 12, Bermuda, hereby gives notice of its intention with effect from September 14, 2012, to rely on the provisions of section 113(1)(cd)(i) of the Companies Act 1981 and to carry on business in reliance upon the provisions of section 114(1)(e) of the said Act and accordingly hereby notifies the Minister that its shares are listed on the Bermuda Stock Exchange and that it is engaged as a business in a material way in the telecommunications industry.”
