is being sued by its former landlord.

But the agency, Scott Crafts, has taken a counter action against Gibbons & White who are suing for rent and alleged damage to the property.

It is claimed Scott Crafts left the Commerce Building in Hamilton in poor condition and with rent arrears outstanding.

Both Scott Crafts and Gibbons & White, however, have denied rumours that the agency was evicted from the building.

Scott Crafts' lawyer Mr. Julian Hall said yesterday: "I do not know where you got that idea from. They did not leave because of non-payment of rent. We must scotch any suggestion that they have been evicted.

"They left because of downsizing of the company. Like just about every company in advertising they are feeling the pinch of the recession. The situation is no different than many others. They were acting to get away from having to pay excessively high rents.

"There is an action and a counter action. The action is primarily for alleged damage to the property following them leaving the premises.'' Mr. Hall said that there was also a small rent charge for a period before Scott Crafts were able to move belongings from the building. But he said that is also disputed because notice of termination had been given.

Scott Crafts is now housed in a building on Court Street, formerly the home of the Brown and Wade law firm. The dispute will go to court on October 22.
