HSBC files writs against Tucker’s Point and Govt over documentation defect
HSBC Bermuda has filed three writs against the Tucker’s Point resort and Government.But the bank said yesterday that the legal action was simply to “correct a technical defect” in corporate documentation.HSBC was the lead lender to Tucker’s Point, an 88-room hotel, residence club, beach and golf resort that opened in 2009.The series of writs filed in Supreme Court on Tuesday by HSBC are as follows:- Between: HSBC Bank Bermuda Ltd VS (1) TPC Hotels Ltd 2) The Minister of Business Development and Tourism. October 16, MJM Barristers & Attorneys.An HSBC spokesperson said: “HSBC Bank Bermuda Ltd has been working with three Tuckers Point subsidiary companies, to correct a technical defect with respect to corporate documentation dating back to the 2004 to 2007 period. This has involved filing three applications with the Supreme Court of Bermuda, which required the three Tuckers Point subsidiaries and the Minister of Business Development and Tourism to be included as parties to effect the technical rectification.”Tucker’s Point had no comment on the writs.Last year Tucker’s Point fought a heated public battle for a special development order (SDO) to expand and build dozens more luxury homes on the property that it said would be sold to help repay an initial $85 million loan with HSBC Bermuda. Rosewood Hotels operates the resort.
