Calvin Anderson, 57, of Wellington Slip Road, St. George's, said he was driving tourists back to the Grotto Bay Hotel in the early hours of September 27 when he saw a cycle in the middle of the road at Blue Hole Hill.

In Magistrates' court yesterday Anderson explained how he told other bystanders to call the Police. When Police arrived at the accident scene they spoke to Anderson and detected the smell of alcohol on his breath.

Anderson agreed to take a breath sample and was taken to Hamilton Police Station and was found to have 206 milligrammes of alcohol in 100 millilitres of blood. The legal limit is 80 milligrammes of alcohol in 100 millilitres of blood.

Anderson admitted driving while impaired that morning but denied being part of an accident -- an explanantion that Magistrate Ed King accepted .

"I know exactly what I was doing,'' Anderson said. "I had all that in my system from the day before. Just as I was going across the bridge I saw the bike. I don't know nothing about the accident.'' "So Police latched onto you?'' Mr. King asked. "Okay, I'm satisfied that you were not involved in the accident so I don't consider a custodial sentence warranted.

"At 1.30 the day before is only an hour and a half away. And you were at 206.

Man, you must have been high to hell and back and back up to heaven for you to be coming down to 206!'' Anderson was banned from driving all motor vehicles for one year and also fined $1,000.
