Jury clears defendant in sexual assault trial

A Supreme Court jury took 90 minutes to unanimously find a 32-year-old Warwick married man not guilty of indecently assaulting a 19-year-old Pembroke woman yesterday.

The court heard on Monday how the complainant accepted a lift with the man while she was at a Warwick bus stop on April 26 last year.

She alleged she was visiting friends near Jones Village and did not know the man she took the ride with personally. The court heard the woman initially refused the lift but went ahead when the accused man persisted and the bus was late.

The complainant alleged the two stopped near the junction with Harbour Road and Longford Road, Warwick because the man wanted to talk. The complainant alleged she suggested an area with more lights like her residence.

She claimed the man took her to Belmont Golf Course and asked if she wanted to have sexual intercourse with him.

She also told the court the man begged to sleep with her, and told her: "You girls are so stupid. You sleep with guys who don't care about you but you won't sleep with the ones that do.'' The Pembroke woman alleged she tried to get away from her attacker but he embraced her and attempted to feel her private parts by forcing his hand down her pants.

She claimed she pushed the man off and ran over the golf course to Middle Road where she eventually got a ride with a stranger on a motorcycle.

The next day she stated she and a cousin confronted the man and his wife, but he denied the sexual assault and told them that as he was a Rastafarian, such behaviour was against his religion.

The accused man told the court on Tuesday that he was stopped at 11 p.m by the 19-year old who was standing at a bus stop on Middle Road, Warwick.

He said it was the woman who persuaded him to take her to Belmont and she asked him if he wanted sex.

The complainant got offended, he said, when he refused her advances and told her she needed a nice guy to take care of herself and her child.

He also denied fondling the woman.
