Magistrate puts repeat offender who assaulted girl on probation
A man who assaulted a 13-year-old girl was put on probation for two years in Magistrates' Court on Friday.
Psychiatric tests were also evaluated by Magistrate the Wor. Cheryl-Ann Mapp.
Winston Duncan, 33, of Sunset Close, Pembroke pleaded guilty to the charge in Magistrates' Court on December 17.
Last month the court heard that on December 11 a 13-year-old girl was standing at the bus stop on Point Finger Road, Paget, near the King Edward VII Memorial Hospital.
Crown Counsel Ms. Sharon Kenny told the court that Duncan exposed himself to the girl and then grabbed her as she tried to run off.
The girl ran into the hospital followed by Duncan who said: "I'm sorry. Don't tell anyone.'' In court on Friday Crown Council Mr. Steve Harrison said: "Incarceration has not been tried with Duncan. He needs to know that this type of behaviour is not going to be tolerated.'' "He is able to differentiate right from wrong. It must be made clear that he is at the end of the road with these types of things.'' The probation officer for the case said Duncan was diagnosed as having schizophrenia and that if treatment could not be found in Bermuda overseas treatment could be looked into.
He added: "A change of location may be of some assistance in treatment.'' Mrs. Mapp said: "For the past ten years you have been harassing women on various scales on this Island.
"You are now at the end of the road. This court has the duty to protect members of the public from the likes of you.
She added: "You cannot do what you wish with parts of your body. This was a 13-year-old you did what you did to, she is the fourth person you have affected.
"You know there is a problem. If you cannot socialise with women keep to yourself, be anti-social.'' Mrs. Mapp put Duncan on probation for two years with conditions to attend St.
Brendan's Hospital for evaluation and treatment adhering to whatever programme is organised for him.
