Junior Crown Counsel Veronica Gordon told the court staff at the Hayward's Supermarket in Warwick observed Smith place four cans of nuts inside his jacket on December 29.

However, a staff member brought the man back into the building and summoned the Police.

Junior Crown Counsel Veronica Gordon told Magistrates' Court Police officers saw Wayne Albert Hanley in the parking lot between Court and Union Streets on January 22.

When officers approached the man he quickly walked away, jumped up the northern side of the lot and into a second floor door.

He then locked the door and remained inside for a few minutes before exiting the same door and surrendering himself.

"It's gone. I had a rock, but I swallowed it,'' he reportedly told Police.

Senior Magistrate Will Francis ordered Hanley to pay a $200 fine or serve 14 days in prison.
