Man denies sexual assault
a knife before trying to sexually assault her.
The mother of three, who cannot be named for legal reasons, told Magistrates' Court that after spending some time with the defendant earlier in the day, she awoke to find him standing over her bed clutching a kitchen knife.
And her ordeal did not end for over five hours as the man repeatedly tried to have sexual intercourse with her.
The 45-year-old St. George's man pleaded guilty to threatening a woman with intent to cause alarm, but not guilty to breaking and entering with intent to commit a felony, and sexual assault.
The offences were alleged to have occurred on the evening of May 16 into the early morning of May 17.
The plaintiff, also a St. George's resident, said she knew the defendant and started her testimony by saying she phoned him to ask for help to pay a phone bill.
The defendant met the plaintiff and said he had to go and clean a pool, and she agreed to go with him.
They made a further stop before going back to the plaintiff's apartment at approximately 8 p.m.
An argument took place between the two concerning a personal matter and the defendant left the house, only to return 15 minutes later with a bottle of Cockspur rum and a few beers.
The plaintiff said at some point the defendant started to get "sloshy'' and spilled his rum on the floor.
She said: "He was acting inebriated and so I asked him to leave.'' He did leave and the plaintiff said she removed her clothes and got ready for bed.
She said she was dozing on the couch when she heard a loud knocking coming from the back door of her upstairs apartment.
The door was locked but she recognised the defendant's voice asking to be let in.
However, the plaintiff said she was afraid and left through the front door, and hid in her neighbour's driveway.
Meanwhile, the defendant smashed his way through the door into the woman's apartment but found it empty.
The woman said after five to seven minutes she saw his car drive past and so went back to her apartment.
She put an ironing board in front of the smashed open door and went to bed.
She said she woke up with the defendant standing over her with a kitchen knife in his hand saying: "Wake up you b****''.
He then allegedly seriously threatened her, and the plaintiff said: "I was absolutely stunned and shocked and I totally feared for my life''.
The plaintiff continued: "He pursued his anger toward me by calling me names and saying I had no right to be alive and I had ruined his life, then I put the cover of the sheet over my head and he got on top of me and pulled the sheet down, pulled my robe open and completely against my will, he tried to have sex with me.
"I vehemently resisted by tightening the muscles in my thighs.'' She said he spoke to her in a vulgar manner and continued to threaten her.
The defendant had taken his clothes off by this point and continued to behave in a very threatening manner, and again tried to have sexual intercourse with her.
However, he was not able to and the plaintiff said: "When he realised he would get no co-operation he stood at the foot of the bed in front of the mirror and proceeded to masturbate himself, simultaneously speaking vulgar coaxings.
"As he stood in the mirror I was telling myself this man is a very sick man.'' Richard Horseman, representing the man, alleged that the plaintiff was making sexual advances toward the defendant as well as the owner of the house and that they were also smoking crack cocaine.
All of these allegations were vehemently denied by the plaintiff.
Mr. Horeseman alleged that the plaintiff and defendant also smoked crack cocaine at her residence, but again she denied this.
He also put it to the plaintiff that the defendant had never said the vulgar remarks about how he wanted to have sexual intercourse with her, but again she denied this, insisting she had told the truth.
