Terrence Gideon Bowens, 25, of Clarendon Road, appeared in Magistrates' Court charged with entering a house without consent and assaulting his estranged wife.
The court heard that Bowens went to his mother-in-law's house in St. George's, where his wife was residing, around 1 a.m. on April 13. There he found the door to the house wide open and his wife in bed with another man.
A fight broke out and during the scuffle he punched his wife in the face.
Police were called and arrived to find all three people involved in the incident still there.
They examined Bowens' wife's face, which was bruised, and arrested Bowens. It emerged that Bowens had been separated from his wife for about five months, due to marriage difficulties, and they were currently living apart.
Bowens said "I'm very sorry for what I did. When I went down there and saw my wife in bed with another man, I did what any man would have done, I lost my cool. It won't be going on anymore as I'm going to the lawyers today to file for divorce.'' Senior Magistrate Archibald Warner said he would give Bowens some cheap advice.
He said he understood Bowens was upset but added "these days, regardless of what your wife is doing, nothing gives you the right to hit her''.
Mr. Warner fined Bowens $200 for unlawfully entering the house and $300 for assaulting his wife.
"All I have to say,'' he added, "is stay away from your wife.'' Antonio Casimiro Simas, 62, of Happy Valley Road, Pembroke, pleaded guilty to working without a work permit for Daponte Landscaping & Maintenance between March 13 and April 6 and was fined $1,000.
Police received a tip on April 6 that there was a Portuguese National, who did not hold a work permit, working at a residence in the Devil's Hole area.
Simas was there mowing the lawn and was asked to produce documentation proving he was allowed to work but he could not.
Yesterday Simas told the court he came to the Island to visit his wife and children who lived here.
His daughter had just had a baby while not fully covered by insurance, he continued, so he was working to help her pay the $4,000 bill. Senior Magistrate Archibald Warner asked him how long he had been on the Island and how long he intended to stay. Simas said he had been on the Island for two months and hoped that Mr. Warner would give him permission to stay for another month so he could attend his granddaughter's christening.
Mr. Warner said he could not do that as it was up to the Immigration Department to deal with his future stay in Bermuda and he was liable to be recommended for deportation.
Simas was then ordered to pay a $1,000 fine forthwith.
