Pedal cyclist fined for riding while impaired
impaired.
Warren Wayne Smith, 43, was convicted in Magistrates' Court in a rare case under the Road Traffic Act on Tuesday.
And Magistrate the Wor. John Judge warned drunken pedal cyclists could be almost as much a menace as impaired motorists.
Smith, of Cotswold Lane, Smith's Parish, admitted being over the limit, but was acquitted of riding with excess alcohol.
Insp. Peter Duffy, prosecuting, said Smith was involved in an accident in South Shore Road, Devonshire, on October 12.
A car and a motorbike were also involved in the crash which occurred at around 7 p.m.
Smith told Police, who noticed he smelt of alcohol, he had had two drinks, said Insp. Duffy.
Tests showed Smith had 130 milligrammes of alcohol in 100 millilitres of blood.
The new drink-drive limit, from October 30, is 80 milligrammes of alcohol.
Miss Elizabeth Christopher, defending, said there was no indication Smith caused the road accident.
She pointed out Smith only worked on Sundays, and had limited resources.
