Terry Lee Smith, of Pompano Road, Southampton, pleaded guilty in Magistrates' Court to failing to give a sample of breath, and driving without a valid licence.

A third charge of impaired driving was dropped by the prosecution.

Prosecutor Sgt. Donald Grant said the charges stemmed from an accident at 12.10 a.m. on September 20 on Harbour Road in Paget.

Ms Victoria Pearman, representing Smith, said her client realised that he should have taken the test.
