Drunk driver banned

Elizabeth Ann Pedro was fined $450 and banned from driving all motor vehicles for one year after she admitted having three times the alcohol limit in her blood at 1.05 a.m. on August 10.

Senior Magistrate Will Francis heard Police stopped Pedro when they noted the activated indicator as she drove west on North Shore Road to her Duck's Puddle Road home.

Crown counsel Charmaine Smith told Mr. Francis: "Pedro told Police she left the indicator on so she didn't have to turn it on and off when making several right turns after leaving the Swizzle Inn.'' "Officers noted her breath smelled strongly of alcohol and she was shaky on her feet,'' she added.

Pedro told Mr. Francis: "When I was pulled over I wasn't apparently drunk. I just made four right turns within the space of a minute.'' The woman was found to have 254 milligrams of alcohol in 100 milligrams of blood. The legal limit is 80 milligrams of alcohol in 100 milligrams of blood.

Pedro also challenged the Police breathalyser readings, claiming an officer indicated to her she had failed with a reading of only 108, adding: "I didn't know they could do that.'' And she asked Mr. Francis to not hit her with a driving ban, saying: "I do have my own business that I have built. If I am taken off the road, it would be very difficult.'' Mr. Francis told Pedro he did not have "discretion'' in banning her from driving.
