Evicted tenant sues landlords

Terry Lamb is suing Dennis and Curtis Smith for $5,000 for damaged goods and goods not returned.
Senior Magistrate the Wor. Will Francis heard this week that on July 5, 1992, Lamb and his family moved into the Radnor Road apartment.
Under questioning from his lawyer Ms. Keren Lomas, Lamb said: " As a result of having lost my job and being unable to pay my rent I went to social assistance.
"I received assistance from the Salvation Army after a letter written by Dennis Smith told them how much I owed. They gave me a cheque for $500 to help me with my $1500 rent. The cheque was made payable to Dennis Smith.
"In August I did not receive any more assistance and I still was not employed. I had not paid any further money to my landlords.'' Mr. Lamb told Mr. Francis that on September 1, 1992, his sister called him to tell him that his belongings were being put outside his apartment.
"I found furniture and other household items out on the front lawn.
"I approached Dennis and Curtis Smith, and asked them what was going on. I also asked if they had an eviction notice.'' Mr. Lamb said a brother of the landlords came running towards him, swearing in a very hostile manner.
Mr. Lamb, who is being counter-sued for rent owed and a trucking and storage charge, claimed he had yet to have some furniture, clothing and jewellery returned.
The hearing was adjourned and will continue on November 8.
