Guilty plea in motorcycle offences

Police prosecutor Sgt. Donald Grant said Police on Parson's Road in Pembroke motioned to Smith to stop when he drove past them.

Smith did not and carried on to Glebe Road where he jumped off his bike outside some apartments and ran upstairs.

Police arrested him for driving an unlicensed bike without insurance while he was disqualified and failing to stop for them.

The court then heard that Smith had been in court on Monday for similar offences and had received a three month suspended sentence.

Senior Magistrate Will Francis imposed the same sentence on him again and warned him that if he ever drove a cycle while disqualified again he would be going to jail for at least nine months.

He then fined him $600 for driving while disqualified, $200 for failing to stop for Police, $150 for riding an unlicensed cycle and $300 for having no insurance.

ADDICT PLEADS GUILTY IN CHEQUE FRAUD CTS Addict pleads guilty in cheque fraud Cheque fraud resulted in a drug and alcohol addict being put on two years probation in Magistrates' Court yesterday.

Howard Joynes, 32, of Cable Hill in Devonshire, pleaded guilty to making a false document, uttering the document and inducing a Bank of Bermuda employee to give him $600 under false pretences.

The court heard that Joynes arranged to do some electrical work for a Washington Mall restaurant owner and was given a blank cheque -- as he was believed to be honest -- with which to buy the necessary parts and equipment.

However, Joynes never returned to the site after being given the cheque and when the complainant went to cancel the cheque, he was told Joynes had already cashed it for $600.

Joynes told the court that he was involved in the Salvation Army's Harbour Light programme to help him battle a drug and alcohol problem -- which is what he used the $600 for -- and was very sorry for what he had done.

Harbour Light spokesman David Masters said Joynes was now under 24-hour supervision and was being considered for treatment in Canada.

Senior Magistrate Will Francis sentenced the man to 12 months probation with the added condition that he continue to undergo such counselling and treatment for substance abuse as his probation officer saw fit.

WAITER FINED FOR CANNABIS POSSESSION CTS Waiter fined for cannabis possession A waiter at a South Shore hotel was fined $250 yesterday for possession of cannabis and obstructing a Police officer executing his duty.

Mathyio Simons, 20, of Kitchener Close in Sandys, was discovered about to smoke a homemade cigarette near some derelict buildings near his home by Police officers on January 27.

During a search of Simons, said Police prosecutor Sgt. Donald Grant, he became evasive and pulled a plastic bag out of his pocket and threw it toward the water.

However, the bag fell short of going overboard and it was recovered and later found to contain .18 grams of cannabis.

Senior Magistrate Will Francis fined the man $100 for possession of the controlled drug and $150 for obstructing the Police officer.

MAN SWAM NAKED AT WHALE BAY CTS Man swam naked at Whale Bay A 36-year-old Southampton man was charged in Magistrates' Court yesterday with openly exposing his person on Whale Bay Beach on April 23.

Kevin Johnston of Sunnyside Park pleaded not guilty and asked Senior Magistrate Will Francis to tell him who had seen him and reported him.

Mr. Francis declined to tell him and asked him to return to court on September 10 for trial.

Duty Counsel Julianna Alexander-Jacks said Johnston suffered from paranoid psychotic schizophrenia -- which he was taking medicine for -- and could not remember what had happened during the incident.

Police prosecutor Sgt. Donald Grant said Johnston was swimming at Whale Bay while naked and got out of the water. A member of the public complained to Police and Johnston was later arrested.
