Twenty-two year old Emanuel Tilus, of New Jersey, had been helping Police in their investigation of an offence which was alleged to have taken place on July 22.
Tilus was alleged to have brought eight .380 calibre Winchester live bullets into Bermuda on board a Continental Airline flight.
He denied the charge and was bailed in the sum of $1,000 with a like surety.
Crown counsel Larry Mussenden on Monday told Magistrate Edward King the Crown was offering no evidence in the matter. The Magistrate told Tilus he was free to go, but he may be arrested again and brought back to court.
"He is not found not guilty,'' Mr. King pointed out.
He also noted that whenever a case is brought to the courts, the Crown should be ready to proceed.
"I am worried about the little fellow out there and his rights,'' Mr. King said.
Mr. Mussenden told Mr. King he was the one who made the decision in this case to not offer any evidence.
"I am glad to hear that,'' Mr. King said. "If this matter had gone to trial, he would have been found not guilty.
"Look man, catch the plane and go home,'' Mr. King told Tilus.
Tilus was represented by lawyer Wilhelm Bourne.
