Junior Crown Counsel Veronica Gordon told the court that Police on mobile patrol on Middle Road, Devonshire, were alerted that a driver had just crashed nearby but failed to stop his vehicle.

Seconds later they came across a car which matched the description and noticed it was veering all over the road and had extensive damage to the front.

When Burgess was stopped, Police noticed he appeared to be drunk. Burgess admitted he had had a few drinks to celebrate his birthday but insisted that "had nothing to do with the accident'', confirming Police suspicions that he was involved in the hit-and-run.

The alcohol in his bloodstream was later measured at 164 milligrams of alcohol in each 100 millilitres of blood -- more than twice the legal limit of 80mg per 100ml.

Senior Magistrate Will Francis fined Burgess $450 and disqualified him from driving all vehicles for 12 months.
