After seven hours of deliberation, the seven-man, five-woman jury was unable to reach a majority verdict.
A fresh jury will be called for a retrial in November and bail was extended by Puisne Judge the Hon. Mrs. Justice Wade.
Earlier in the afternoon, a gaff by the head juror who inadvertently revealed how the votes had been weighted, could have caused an early disbandment of the jury.
But Mrs. Justice Wade allowed the jury to continue its deliberations, overruling objections from counsel.
Almost two hours later, the jurors emerged to announce they were unable to reach a verdict on either count.
Simmons, a former DHL Worldwide Express employee, is accused of attempting to smuggle almost two kilograms of marijuana into Bermuda by courier in April.
He was defended by Mr. Richard Hector, while Mr. Peter DeJulio represented the Crown.
