Man in court after cigarette assault
a cigarette after he was told to leave the Table Spoon restaurant, a magistrate heard this week.
Linden O. Simons of Witchery Lane, Warwick pleaded guilty to assaulting the man when he appeared in Magistrates' Court on Tuesday.
Prosecutor Sgt. Peter Giles told the court that on Saturday, May 23, Simons entered The Table Spoon restaurant.
"The man, who was a patron, said that Simons was being a nuisance and made gestures for him to leave,'' said Sgt. Giles.
"Simons left the restaurant. When the man walked outside, Simons approached him, making aggressive gestures. He then pushed his lit cigarette in the right cheek of the man, causing a minor burn.''.
Sgt. Giles added that Simons had several convictions for assault and was presently on probation.
Simons' brother, Owen Simons, spoke on his behalf: "He did his best to avoid the situation. This type of stuff happens to him every day and this is his way of dealing with it.
"This is his survival kit. It is his way of dealing with our society. He went into the restaurant and they told him to get out. He didn't even do anything.'' Senior Magistrate the Wor. Will Francis bailed Simons at $300 and ordered a social inquiry report which will be read on July 22.,
