Michael Dean Eberly, 34, and Michael Brian Pitcher, 31, both of Victoria Row, are jointly charged with murdering Beatrice Simons and breaking and entering her Cochrane Road home between December 1 and 2, 1997.

Mrs. Simons was taken to King Edward VII Memorial Hospital after neighbours heard her screams, but died from severe head and arm injuries six days later.

Eberly and Pitcher were remanded in custody. They will return to Magistrates' Court on January 23 for mention.

MAN FINED MORE THAN $1,000 CTS Man fined more than $1,000 A Paget man was yesterday fined more than $1,000 in Magistrates' Court for various traffic offences which took place last year.

Johnathan Gaugain, 20, of Dudley Hill, pleaded guilty to dangerous driving, driving without due care, and two counts of driving without a valid licence.

Senior Magistrate Will Francis dismissed a charge of failing to stop for Police.

Police prosecutor Sgt. Phil Taylor told the court that around 8.10 p.m. on June 13 Gaugain was seen by Police officers riding on only the back tyre of his auxiliary cycle.

Mr. Francis fined Gaugain $400 for dangerous driving and banned him from riding auxiliary cycles for three months.

Gaugain was also fined $200 for riding without a licence on two separate occasions and $350 for driving without due care when he crashed into the back of car as it slowed down.

Paco Fubler, from Sunset View Road Pembroke, pleaded guilty in Magistrates' Court to possession of an offensive weapon.

The court heard that the 23 year old was detained by Police on another matter on Angle Street on January 2 and was searched at Hamilton Police Station where the knife was found.

Fubler told Police he had the knife because "it's crazy out there''.

Before sending Fubler to prison, Senior Magistrate Will Francis yesterday told Fubler: "You are right. It is crazy out there!'' STAY AWAY FROM VICTIM, MAN WARNED CTS Stay away from victim, man warned Senior Magistrate Will Francis yesterday increased a man's bail by $500 and strongly warned him against contacting an unnamed victim.

Jermaine Riley, 25, North Shore, Devonshire -- who has been charged with causing grievous bodily harm in September -- admitted that his mother had contacted the victim to get her to drop the charges. Riley admitted that he failed to appear at a September mention hearing as he thought his mother was successful.

Mr. Francis ordered Riley to return to court on May 8 for trial. He also granted Riley bail at $1,500 with a like surety, but he stressed that Riley was to have no further contact with the victim.
