Pembroke man jailed for possession and obstruction
30-day prison term yesterday.
David L. Fough, 48, of Marsh Lane, pleaded guilty in Magistrates' Court to possession of drug equipment and obstructing a Police officer on June 29.
Crown counsel Charmaine Smith told the court that Police attended the scene at Bull's Head car park.
They observed Fough walking toward Laffan Street with a white bucket.
The officers stopped him and informed him that they would conduct a search of the bucket, to which Fough was cooperative with the officers.
When the officers informed Fough that they would be searching his person, he resisted, pushing the officer and violently twisting his body, obstructing the officers as they were attempting to detain him.
Fough reached into his pockets and pulled out some coins and threw them to the ground.
He then said: "I'm sorry I have to do this.'' Putting his right hand into his right rear pocket, he pulled out what looked like a crack pipe, and threw it to the ground on Canal Street, breaking it.
A second officer came to assist and Fough was detained and taken to Hamilton Police Station.
Analysis of the pipe showed a presence of cocaine free base or crack.
Ms Smith also told the court that Fough is currently serving a 60-day sentence for a previous offence.
Magistrate Archibald Warner fined him $300 for the possession offence and $300 for the obstruction, with a 30-day prison term on default.
Fough chose to serve the prison sentence.
