Peniston is given a stern warning
present documents to back up his claims today or face going to jail.
He took the stand to begin another examination on charges of bankruptcy.
However, Puisne Judge the Hon. Mrs. Justice Wade warned Peniston that some of his statements were different than the last time he appeared in court.
"You are walking on shallow ground and I won't hesitate to send you to Westgate,'' Mrs. Justice Wade said.
Peniston, who had no legal representation, apologised to the court for failing to show up at his last court date on July 25.
He is said to owe creditors more than $700,000.
In January, official receiver Mr. Mark Diel said Peniston failed to alert the official receiver when he discovered he had assets of $25,000 and $1,000.
Earlier he had sworn an affidavit saying he had personal effects to a value less than $1,000.
Yesterday he questioned Peniston on how he was able to pay $2,000 to the University of Buckingham in England on March 4 and a further $1,914 on May 25, the day after he arrived there.
But Peniston denied that any of the money was his. He said it belonged to his family.
Mr. Diel asked Peniston why he had told Mrs. Justice Wade, during his last court appearance, that he was not intending to leave the Island when in fact he flew out the following day. "I was suffering from a nervous condition at that time and my family got some money together and gave me a ticket to get me out of here. I had every intention to return to this jurisdiction,'' Peniston said.
He added: "It was an open ticket, I had an opportunity to return at anytime but not exceeding December 10. All proceeds so far have come from family.'' Mr. Diel also questioned Peniston about two cheques he cashed from Bermuda Fire and Marine Insurance Company amounting to nearly $25,000 and a cheque from Astwood Dickinson.
Peniston told the court that he gave the money, which was from an old pension account, to his ex-wife Mrs. Oreta Peniston for her time share in Florida and his son's schooling.
However, Mr. Diel said: "Mrs. Peniston said she only received $2,100. And, she also denied attending lawyer Larry Scott's office with you to sign an agreement saying she was entitled to the proceeds of the fund.
"And Mr. Scott said that you came before him with a woman unknown to him as Mrs. Peniston.'' But Peniston denied that was the case, and stated that Mrs. Peniston did indeed receive the money, regardless of the accusations made.
Mr. Diel also asked Peniston about the money he received from Astwood Dickinson.
"I had taken jewellry there for cleaning and I later could not afford to pay for them so I asked if I could sell them,'' Mr. Peniston said.
Mr. Diel asked that Mr. Larry Scott, Mr. Scott Johnson of Astwood Dickinson, and Mrs. Peniston be invited to appear in court this morning when the trial continues.
