Police a breath sample, claimed that his eyes were glazed because of injuries he sustained in an accident, not alcohol.

Ernest Drummond, of Coral Acres Drive, Southampton, pleaded guilty in Magistrates' Court on Thursday to refusing to give a sample of breath on December 19.

Prosecutor Sgt. Phil Taylor said Drummond's cycle collided with a turning car on South Shore Road, Paget after he tried to overtake the vehicle.

A Police officer at the scene noticed that Drummond's eyes were glazed and asked him if he had been drinking.

Drummond replied: "I had a glass of wine.'' When the officer requested a sample of breath from Drummond, Sgt. Taylor said he refused.

Drummond's lawyer Tyrone Chin told Senior Magistrate Will Francis that X-rays taken later that evening showed that his client had suffered a blow to the head during the accident which accounted for his glazed eyes.

Mr. Francis said he accepted Mr. Chin's explanation, but ordered Drummond to pay a $500 fine banned him from motorcycles for two years for refusing the breathalyser test.
