Smith Privy Council appeal expected in July
during the monthly arraignment session.
And Smith, who has been acquitted of the murder of Canadian teenager Rebecca Middleton, could still face a retrial.
But Smith's attorney, Elizabeth Christopher, has lodged a petition with the Privy Council in London, requesting leave to appeal the decision of the Bermuda Court of Appeal which overturned the decision of Puisne Judge Vincent Meerabux that there was no case for Smith to answer and there was an abuse of process in trying him.
The Privy Council's decision is expected on July 28 and Smith's matter has been set for mention again on August 2. Smith is currently free on $125,000 bail.
Meanwhile, alleged child killers Jermaine Pearman and Sharina Tuzo also appeared in court for mention.
Their matter has again been set for mention on July 1 when it is hoped that a trial date can be set.
Coordinating the availability of overseas expert witnesses with the court's schedule has led to delays.
Pearman remains in custody and Tuzo's bail has been continued.
