Speeding lawyer taken off road, but only for cars

Perinchief tried to use recent amendments to the law to persuade the Magistrate not to take him off the road at all.

But Acting Magistrate the Wor. Miss. Charles-Etta Simmons did not agree.

"Your reasons are not special at all,'' she said. "They relate to you not the offence. Mr. Perinchief you know as well as I do that not only must justice be done, it must be seen to be done. I cannot show you any favours.'' She was not persuaded by Perinchief's argument that it was the movement of the fan located in front of his car's engine that the radar picked up.

"I am satisfied the radar was operating properly,'' she said. "The Police officer operated the radar competently. I have rejected your mechanic's evidence.'' Perinchief's mechanic had testified at his trial earlier this year that the radar had picked up the fan speed. He said this speed when calculated using a formula would explain the 62 kph reading. He explained that Perinchief's car was moving at 40 kph but the fan's rotary speed (12 mph) made up the additional 22 kph.

But he (the mechanic) was unable to use the formula to prove his testimony when asked to do so on the chalkboard by Police prosecutor Sgt. Earl Kirby.

In an interview afterwards yesterday Perinchief explained his strategy. "I used the Act which with the amendments allows for a more subjective treatment on the judge's part,'' he said. "It allows a judge to exercise their discretion.

"I was suggesting that there was no need to disqualify me. The Act allows for shorter periods of disqualification and only for the class of vehicle in which the offence occurred.'' After hearing the judgment Perinchief thanked the Magistrate (for allowing him to use a motorcycle).

"Your Worship, that is an offer that I cannot refuse,'' Perinchief said smiling adding, "will I be allowed any time to pay the money?'' "I'm sure you of all people don't need any more time to pay,'' the Magistrate replied.
