Ignoring Police advice ends in $1,000 fine for impaired rider
A Southampton man decided to ride his auxiliary cycle home while nearly three times over the legal alcohol limit despite an earlier warning from Police.
Arundo Fernando had 211 milligrams of alcohol in his system per 100 millilitres of blood. The legal limit is 80 mg of alcohol per 100 ml of blood.
The 38-year-old was seen driving in an erratic manner into Paget Plaza around 2.35 a.m. on October 3, Magistrates' Court was told.
Police approached him and asked if he had been drinking alcohol that night, to which he replied: "I had two drinks, but I am OK to drive."
An officer noticed his eyes were red and encouraged Fernando to secure his cycle and catch a taxi home from there. They found him a taxi, but later learnt he declined the driver's services saying he was about to purchase a snack from the Paget Ice Queen instead.
The same officers later saw Fernando riding his cycle in a "meandering" manner in the west-bound lane and arrested him on suspicion of drink driving.
Fernando told them: "I am sorry I should not have ridden." He was then taken to Hamilton Police Station.
He pleaded guilty to riding his cycle while over the legal limit.
Senior Magistrate Archibald Warner fined him $1,000 and disqualified him from driving all vehicles for one year.
