Man admits sexual abuse against three youngsters

A man who sexually abused three young siblings admitted charges of serious sexual assault, sexual exploitation and committing an act of indecency yesterday.

Jonathan Cumberbatch raped a girl, got one of her brothers to touch her in a sexual manner, and got her to touch her other brother sexually.

Cumberbatch, 47, from Warwick, also touched one of the brothers himself in an indecent manner.

No details relating to the case were given by prosecutor Carrington Mahoney during yesterday's monthly arraignment hearing at Supreme Court. However, prosecutor Cindy Clarke told a previous hearing at Magistrates' Court that the two boys and the girl were aged ten, 11 and 12 at the time of the crime in 2008.

The siblings are not related to Cumberbatch, who has a previous conviction for a similar offence, for which he received a two year conditional discharge.

No further details about the case can be reported in order to protect the victims' anonymity.

Puisne Judge Carlisle Greaves ordered psychological and social background reports and remanded Cumberbatch into custody until the June 1 arraignments, when a date will be fixed for his sentencing.

In another case before the court yesterday, a 17-year-old boy from Devonshire denied seriously sexually assaulting a 53-year-old woman, and assaulting her causing bodily harm. No details about the case were given, and neither the accused nor the alleged victim can be identified for legal reasons.

The judge bailed the teenager until the June 1 arraignments.

Meanwhile a husband and wife facing two separate cases of alleged fraud told the judge they do not have legal representation.

David and Antoinette Bolden, who ran Emerald Financial Capital International Ltd, are said by prosecutors to have knowingly issued misleading documents, and filed information to the Bermuda Monetary Authority (BMA) which was false and misleading.

The alleged offence, under the Investment Business Act, is said to have been committed between September 20, 2008, and October 20, 2008. The pair denied that charge when it was put to them yesterday.

Mr. Bolden, 47, and his 46-year-old wife also face 24 charges of stealing and money laundering relating to funds allegedly taken from Emerald Financial Capital International Ltd. Those offences are alleged to have taken place between May 2007 and January 2009.

The pair, from Hamilton Parish, have already pleaded not guilty to those charges. Yesterday, they requested that both cases are dealt with at the same time when they go to trial.

They had been represented by lawyer Delroy Duncan at previous hearings, but he has now come off the record. Their original April 9 trial date was postponed by the Chief Justice to give them more time to find a lawyer.

Answering an inquiry yesterday from Mr. Justice Greaves about whether they've secured representation, Mr. Bolden replied: "We're seeking a variation of a freezing order that was placed on our assets. It was heard last week and adjourned for two weeks. We're hoping once that's heard that will give us some clarity with regards to our financing."

The judge bailed them to come back to court for an update on June 1.

Also before the court was Thisley Dawson, 42, from Warwick, who pleaded not guilty to wounding Gregory Campbell with intent to do him grievous bodily harm on May 25 last year. No details were given, and the judge bailed Dawson until his trial on July 19.

In another case, Devon Hewey, 21, from Pembroke, denied attacking the same man, Derrick Astwood, twice in two days. He allegedly assaulted Mr. Astwood on April 15 in Pembroke. Two days later, he's alleged to have burgled a premises in Marsh Folly Road, Pembroke, and inflicted actual bodily harm on Mr. Astwood while armed with a machete. He denied aggravated burglary in relation to that allegation, and was bailed until his trial on May 19.

Also before the court was Collin Leroy Hendrickson Jr, 18, of Pembroke. He's charged with stealing $5,000 in cash, gold jewellery, a diamond earring, and two PlayStations during an armed burglary in Curving Avenue, Pembroke, last June 17.

Prosecutors allege that Hendrickson was armed with a knife and bottle during the burglary, which was committed with others. He's also accused of conspiring to carry a firearm with criminal intent and wounding Jahdean Gibbons with intent to do grievous bodily harm during the incident. He pleaded not guilty to all the charges and was remanded into custody until the next arraignments session.
