Man who blocked road with bike pays
A man who stopped his cycle in the middle of the road to talk to a "lady friend" and refused to move was handed a suspended sentence yesterday in Magistrates' Court.
Jerkeyo David Berkeley, 29, of Alexandra Road in Devonshire, could face up to three months in prison if he doesn't stay out of trouble for the next two years, explained Senior Magistrate Archibald Warner.
Berkeley pleaded guilty to obstructing justice, uttering threatening words and violently resisting arrest at 3.30 a.m. on Sunday while outside Police Headquarters on Prospect Road in Devonshire.
The court heard that Berkeley, on a motorcycle, stopped the flow of traffic in order to have a conversation with a woman in a car. Police driving in the area used their horn to get him to move, but he refused saying: "I am not moving until I am ready."
Berkeley became aggressive with officers, who took it upon themselves to move his cycle out of the road. "You don't know me, I would split your head, you don't know me," he said, while allegedly approaching them with a helmet.
Berkeley told the court he didn't realise it was Police in the car behind him and denied coming at them with a helmet, maintaining the helmet was on his head. He also told the court he was "rushed" to the ground by Police and suffered pain to his jaw and wrist during the arrest.
He was fined $500 for each of the three offences — obstructing justice, uttering threatening words and resisting arrest — and given a three-month suspended sentence.
Berkeley's cycle was unlicensed and uninsured and he did not have a valid driver's licence at the time of the offence. He was ordered to pay $1,000, $250 and $100 respectively for those offences and given 11 demerit points.
