Questions that Dave Middleton wants answered regarding the investigation and
1. What facilities are there in Bermuda to have expert pathologists brought in at the earliest stage to carry out an additional autopsy? 2. If forensic samples were taken, apart from semen, from Rebecca's body what were they and were the results recorded? 3. Considering the magnitude and brutality used in the slaying of Rebecca, why were Police unable to find any forensic trace of Justis Smith, the man accused of her murder? 4. Dave Middleton was told that Justis Smith had three scratches on his arm at the time he was arrested. Were any photographs taken of him, in particular the scratches? 5. Police cadets were sent to search for evidence at the scene of the murder in Ferry Reach. Is it usual to have cadets taking such an important role and is it considered good practice? 6. Was a reward offered for information leading to Rebecca's killers? In hindsight, would that have been a good path to follow? 7. Who initiated the idea to charge suspect Kirk Mundy with accessory after the fact, and why was there a rush to bring charges? Why was Mr. Middleton not told about the charges until after he had been sentenced? 8. Why did the Attorney General's chambers, including the Senior Crown counsel, accept Mundy's plea to the lesser charge, rather than prosecuting for murder? 9. Mundy, who was already on bail for armed robbery at the time Rebecca was killed, was said to be known to many Police officers as an "out and out liar''. Why did detectives automatically believe his version of events, and in particular his lack of involvement, in the murder? 10. Why did prosecutor Khamisi Tokunbo ask the judge sentencing Mundy to consider just a three-year jail-term, when the maximum for that offence was seven years, and when the judge himself thought the crime warranted a five-year term? 11. On the night Rebecca was murdered, she and her friend Jasmine Meens had a camera with them. Why were the photographs taken that night inadmissable as evidence for the trial of Justis Smith? 12. Justis Smith claimed in his statement that he was with Mundy all night on July 3, 1996. Does that not mean that they were together at the scene of the murder? 13. Why was former Police Commissioner Colin Coxall, who was head of Bermuda Police Force at the time of the murder, not invited to give evidence at the inquiry?
