Residents sue minister
is succesful in getting a Government decision overturned.
Residents of Southdown Farms, an upscale condominium property, are suing the Minister of the Environment for allowing the Reefs hotel to build a 16-unit dormitory near the Southampton property.
The property owners opposed the plan to build the dormitory in an open hearing of the Development Application Board earlier this year.
But the board decided to allow the expansion and so the Southdown owners then tried to get that decision overturned by the Minister of the Environment.
The Reefs application to build the dorms was reviewed by an independent overseas inspector who advised the Minister to allow the expansion.
The Minister followed the inspector's advise and did not overturn the Development Board's ruling.
Solicitors representing the Southdown Farm's Board of Directors, have now filed a writ in Supreme Court, hoping to overturn the Minister's decision.
"Its the neighbours seeking another step in the objection process.'' said The Reef General Manager Neal Stephens.
The Reefs will be a by-stander in the legal process but has an interest in the outcome that will determine whether or not they downsize the dorms, or not build at all.
The staff dormitory would be built on the North side of South Shore road across from hotel, behind the water catch on hotel property.
Southdown properties are about 50-feet at the closest point to the development site.
Representatives of the Ministry and Southdown Farms were not willing to release information about the case since it is before the courts now.
