But he was relieved to hear Senior Magistrate the Wor. Will Francis say it was not his fault and the visitors Walter and Meredith Dabberdt had become panicky, scared and fell off the hired motorcycle.

Dabberdt who flew back to the Island to give evidence in August said the accident happened when he and his wife were visiting Bermuda for their 25th wedding anniversary last September.

They were leaving Glencoe Guest House on a livery cycle traveling at a speed of around 10 kph, according to Dabberdt.

He said they were on Salt Kettle Lane going around a curve when a large truck came speeding down the hill.

Dabberdt added that at least half the truck was on his side of the road. He told the court that he took immediate evasive action, swerving to the left to miss the truck. The bike hit the pavement and Dabberdt and his wife fell off suffering injuries.

Smith denied driving without reasonable consideration for the other road users.

He said that he was travelling at a reasonable speed although his truck my have been slightly over the centre-line because of its width on the narrow road.

Smith said he believed Dabberdt had panicked as he drove past and that had been the cause of the accident.

In closing Mr. Francis said: "The cause of the accident was the visitors inexperience with motor vehicles and his inexperience with driving with other large vehicles.

"Smith did not drive without reasonable concern.''
