BlackBerry video contains apparent threats on 'Parkside'
A jury heard how an alleged shooter was caught on cellphone video with another man, apparently making threats to Parkside.
Detective Constable Rohan Henry identified Anthony Swan as the man being filmed, and the voice behind the camera as Alvone Maybury's.
Swan, 22, is accused of shooting at Raymond "Yankee" Rawlins on Court Street on December 16, 2009, four days after the recording.
He's alleged to have used a motorcycle to arrive and leave the crime scene on the same motorcycle Maybury was seen with on St. Monica's Road earlier that morning.
According to a transcript of the video prepared by Det. Con. Henry, Maybury, 24, says: "So I'm saying, what you tell them Parkside niggas that."
Swan, making a gesture with his hand, then says: "Bang bang on you b**ch ass nigga."
With Maybury, responding: "Tell 'em your name."
Swan says: "The mother f*****g [inaudible) b**ch.
The next thing heard from Maybury, according to the transcript is: "Niggas are coming for you guys real soon, trust me. Yah big time."
Swan then says: "S**t, you want to see something."
With Maybury responding: "Yah, I don't, I don't, don't show it to 'em. Don't ever pull, you know you don't want that shit on camera."
Both men can then be heard laughing. However, Chief Justice Richard Ground warned the jury that the transcript is only Det. Con. Henry's analysis of what was said, and they should rely on their own judgement.
The court has previously heard that the video was extracted from a BlackBerry device examined by Police technology department officer Robert Goodchild, and dated December 12, 2009.
Defence lawyer Marc Daniels pointed out that neither man says on the video that they are going to shoot someone.
"Not in the exact words that was said," replied the detective.
"You really don't know what it was all about, do you, that video clip?" suggested the lawyer.
"I have a pretty good idea what it was about," replied Det. Con. Henry, though he did not elaborate. He was not asked to explain what Parkside is.
The court later heard a statement from Police Constable Abner Callaghan who stopped and searched Maybury on St. Monica's Road, just under two hours before the shooting took place.
He said the search, under the Misuse of Drugs Act, found nothing illegal on Maybury, of Crane Lane, Pembroke.
Maybury reportedly identified a Honda motorcycle that was parked nearby as the vehicle he was riding.
The court has already heard from other Police that Swan was riding the same bike when he was spotted on St. Monica's Road shortly after the shooting. Following a high-speed chase, he was then arrested after crashing into a Police car.
Swan, from Pembroke, denies a string of charges including shooting at Mr. Rawlins with intent to do grievous bodily harm and the case continues.
