Court upholds Lewis’ sentence, conviction

The Court of Appeal today dismissed an appeal by killer Kellan Lewis against his conviction and jail sentence for the stabbing of Kellon Hill.Supreme Court president Justice Edward Zacca upheld Lewis’s term of imprisonment.He said the court was “of the view that the sentence of 12 years is not manifestly excessive”.The 2010 decision of the Supreme Court jury that convicted Lewis was also affirmed.Mr Hill was killed following a late-night party at Elbow Beach.Lewis had been accused of the August 2008 stabbing murder of the 18-year-old.He was cleared of the charge last year, but found guilty of manslaughter and possessing a bladed article in public.Justice Zacca, with Justices Sir Anthony Evans and Sir Robin Auld, wrote that the Court of Appeal was satisfied there was “sufficient evidence for the jury’s consideration and for the jury to reasonably conclude whether it was the appellant who inflicted the fatal injury”.Their judgement stated: “In the final analysis the jury convicted the appellant for the offence of manslaughter. If the verdict was based on the finding that the appellant inflicted the fatal injury, the jury must have concluded that there was no intention to kill or to cause grievous bodily harm. such a verdict was open to them based on the directions of the Judge.“In the circumstances the appeal against conviction is dismissed and the conviction affirmed.”
