BBC fined for naming accused sex offenders

The Bermuda Broadcasting Company (BBC) was this morning fined in Magistrates' Court for unlawfully naming two accused sex offenders.According to Crown counsel Cindy Clarke, on November 9 last year a man was charged in Magistrates' Court with a number of offences, including sexual assault.In a report on the appearance, broadcast on Power 95 and ZBM, later that day, the defendant was named in connection with the sexual assault charge.And in a separate incident this March, Ms Clarke said the BBC named a cruise ship worker, who was acquitted of a sexual offence, on Power 95 following a trial in Magistrates' Court.BBC CEO Rick Richardson pleaded guilty to two counts of unlawfully naming the accused in a sex offence case, one count related to each incident.In Bermuda, it is an offence to identify the accused in a sexual offence case unless they have been convicted, or enter a guilty plea. The offence carries a maximum penalty of a $5,000 fine.Representing the BBC, defence lawyer Mark Pettingill said the incidents were mistakes, and that the company and the reporters accept full responsibility of the errors.Senior Magistrate Archibald Warner fined the company a total of $6,000 for the two offences, saying that the Island's news media must be responsible with its reporting.
