Rabain calls for tougher domestic violence laws

Opposition Senator Diallo Rabain yesterday called on Government to examine the possibility of mandatory prosecution in cases of domestic violence where there is an obvious injury to one party.Sen Rabain noted that unlike parts of the United States such as Florida, Bermuda law relies on the alleged victim to pursue a prosecution.In Florida, “whenever police are called to a domestic dispute and they witness an obvious injury to one of the parties, the other person goes to jail, the other person gets prosecuted”, he said.“The person does not get a say on whether to recant or not prosecute, because once the police has determined that an assault happened the prosecution goes forward.“In Bermuda, to my understanding, the victim can still recant and say ‘no don’t prosecute, we’ve made up,’ and move along. I think that’s something I would urge the Government to look into and make it a mandatory prosecution.“Far too often we have our young ladies that are being assaulted that are victims of domestic violence and domestic abuse. As we all should know, domestic abuse is a disease and it can be recurring. And you go through a good period and everyone’s happy.“I think we need to send a message to anyone who wants to assault another especially in a domestic situation, that we are not playing with them — we are dead serious — that if you want to assault, especially young men, if you want to put your hands on a woman you will go to jail. You will be arrested.“There will be no ‘I’m sorry baby’ to bring you back.”His comments came during the Senate’s motion to adjourn.
