Leyoni Junos loses eviction appeal

Former civil servant Leyoni Junos has been dealt another blow by the courts in her struggle to challenge her eviction.But yesterday Ms Junos told The Royal Gazette she still intends to continue the fight.Three years after HSBC Bank claimed possession of her Warwick residence, the Court of Appeal refused to grant leave for Ms Junos to appeal a June, 2012 ruling by Chief Justice Ian Kawaley.Mr Justice Kawaley’s ruling last year had struck out her earlier challenge of the judicial order granting possession of the property — plus claims of fraud and duress linked with the validity of the mortgage itself.Ms Junos has been denied permission to appeal, and has been barred from pursuing on fresh grounds “any other claim seeking to impugn its validity”.The ruling by Justice Sir Robin Auld, backed by Justices Ian Forte and Patricia Dangor, called her latest challenge “a classic case of attempted relitigation”.It also dismissed her application for an injunction to stop HSBC from enforcing its possession order — and ordered Ms Junos to pay the costs of the application.Undaunted, Ms Junos said: “There are still some issues that need to be addressed, and they might need to be addressed in another arena. ”
