ROSEBUD TRUST (WILLIAM COX) WATERFRONT PROPERTIES,Proposed Retroactive Application for 2 Prefabricated Storage Huts.P0117/12 Type: Final Decision: ApprovePlanner: Victoria CaroloDiscussion: The technical officer presented the application to the Board and explained the issues relating to the proposal and the proposed conditions which were designed to ensure that the structures remained on site for a temporary period only.Members were concerned thatthe applicants had shown a blatant disregard of the planning process by erecting the eco tentsprior to submitting an application, and requested an Advice Note be added to that effect.Members also expressed concern about the vulnerability of the eco tents at times of extreme weather conditions and wished to be reassured that such matters would be addressed at thebuilding permit stage. Technical officers advised this would be the case and suggested that condition 1 could be expanded to require a contingency plan to be submitted with the buildingpermit application to demonstrate what measures would be put in place to ensure that the tents and their contents could survive extreme weather conditions. The Board agreed to amend Condition 1 accordingly and resolved to support the officer recommendation. The Board RESOLVED:To approve the application, as received 30 March, 2012 subject to the following condition(s):1. For the avoidance of doubt the consent hereby granted is for retroactive planning permission only. A separate application for a retroactive building permit must be made and approved. The submission shall demonstrate how the hereby approved structures will be adequately affixed to the ground, and shall include a contingency plan to demonstrate measures which will be put in place to safeguard the structures and their contents in extreme weather conditions.2. Unless used in connection with the approved development under P0548/10 in accordance with condition 3 below, the permission hereby granted shall be for a limited period only, expiring no later than 2 years from the date of this decision, when the buildings shall be removed and the land shall be restored to its former condition.3. Prior to the issuance of a Certificate of Occupancy for the Building Permit associated with P0548/10, the eco tents must be removed from the site.Advice Note:The Board wishes to express concern that the applicant has shown blatant disregard for the planning process in that development has commenced prior to planning approval.2.
